In these terms Vale Photos is referred to as the "Company" and the customer is referred to as the "Customer".
1. TERMS OF THE CONTRACT
- Receipt of a deposit or balance from the Customer shall be deemed as an acceptance of any quotations and our Terms & Conditions of sale.
- All the terms of the Contract between the Company and the Customer are contained in this document. No variation to the printed terms of the Contract shall bind either party unless the variation is made in writing and signed by the party to be bound
2. STATUTORY RIGHTS
- The statutory rights of the Company and of the Customer are not affected by the terms and conditions of this Contract.
3. PAYMENT SCHEDULE
- Weddings & Events; a booking fee of £250 will be required against work commissioned. No request for a date shall be guaranteed until deposit has been paid. The remaining balance shall be due one week before the wedding date.
- Studio & Location Portraits; 100% of the balance will be due upon commencement of the photo shoot.
- Prints & Wall Art; 100% of the balance will be due before production of prints, unless otherwise authorised by the Company.
- Other Commissioned Work; a deposit of £250 or 30% (whichever is the greater) will be required against any work commissioned other than those stated in condition 3.1 and 3.2 above, with the balance due immediately on completion of the project.
4. PAYMENT METHODS
- We accept all major credit cards (with the notable exception of American Express) and process all card transactions through either RBS-WorldPay or PayPal. Other methods of payment accepted are cash, cheque and bankers draft.
- Please make all cheques payable to 'Vale Photos'
- Please note we charge a handling fee of 2.5% for processing all credit card transactions.
5. PRIVACY POLICY
- We do not store credit card, or other payment information anywhere on our systems.
- Vale Photos collects details provided by you on the request of an order. These details are used only for the purpose of completing the order and are not stored anywhere once the order is finalised. The Company undertakes to take all reasonable precautions to protect the confidentiality of any information given by the Customer insofar as it is possible to regulate the data involved. No customer details are ever offered or sold to third parties.
6. DELIVERY METHODS
- We use Royal Mail First Class for all our deliveries, and any delivery valued at more than £50.00 is sent via recorded services. For an additional fee we are happy to send orders via Special Delivery (please ask at the time of ordering)
7. DELIVERY TIMES
- for all print orders - standard delivery is 7-10 working days
- for album orders - standard delivery is 3-4 weeks
- for wall-art orders - standard delivery is 2 weeks
8. NON-PAYMENT
- When payment is not made on the due dates in accordance with condition 3 above, the Company shall be entitled to charge interest on the outstanding amount at a rate of 2% per month from the due date until the date of actual payment and the Customer shall indemnify the Company in full against all loss, including loss of profit costs (including the cost of all labour and materials used) damages charges and expenses incurred by the Company as a result of default in payment as detailed in condition 3 above. No digital files shall be relinquished by The Company until such time that all balances are paid in full.
- For weddings & events, when payment is not made on the due dates in accordance with condition 3 above the Company shall not be liable to attend the wedding or event, and shall do so only at it's own discretion.
9. COMPLETION
- The Company shall use its reasonable endeavours to ensure completion of the work specified within the period quoted PROVIDED THAT the Company shall not be liable for any delay in the completion of the work to the extent that it arises from causes beyond the reasonable control of the Company.
- COMPLETION shall be deemed to be:
- Weddings, Events & Portraits; the point at which the completed work (prints or digital files) is handed over to the client.
- Other Commissioned Work; the point at which the original parameters of the commission have been satisfied.
10. RIGHT OF OWNERSHIP
- Copyright for any and all photos produced by the Company remain the sole property of the Company. No photos produced by the Company may be copied, edited, transferred or reproduced by anyone without the sole permission of the Company. Infringement of copyright is an offence and will be dealt with accordingly. For all services where 'copyright-free' images are to be supplied a letter of consent will be provided automatically by the Company.
11. LIABILITY
- Subject to any responsibilities of the Company towards the Customer pursuant to the Consumer Protection Act 1987 the Company shall not be liable for consequential loss of any nature whatsoever (including loss of earnings) arising from any circumstances beyond the reasonable control of the Company save for death or personal injury relating to negligence.
12. CANCELLATION
- Weddings, Events & Portraiture; There is a cooling-off period of 14 days after payment of a deposit whereby the Customer has the right to cancel the booking and will under such circumstances receive 100% of their deposit back.
- Prints; No order which has been accepted and processed by the Company may be cancelled by the Customer except with the agreement in writing of the Managing Director of the Company and on the terms that the Customer shall indemnify the Company in full against all loss including loss of profit costs (including the cost of all labour and materials used) damages charges and expenses incurred by the Company as a result of the cancellation.
- Other Commissioned Work; For any cancellation made within two weeks of the agreed start date the Customer shall indemnify the Company in full against all loss including loss of profit costs (including the cost of all labour and materials used) damages charges and expenses incurred by the Company as a result of the cancellation.
13. LEGAL VALIDITY
- If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
- The Contract shall be governed by the laws of England to avoid any doubt should there be a legal argument.
14. CONCESSIONS
- Any concessions latitude or waiver allowed by the Company at any time shall be without prejudice to its right under this Contract and shall not prevent the Company subsequently exercising such rights.
